Please read carefully and ensure that you understand and accept the terms and conditions outlined here.
Introduction: This Website is provided solely to assist customers in gathering travel information, determining the availability of travel-related goods and services and making legitimate bookings and for no other purpose. The terms “we”, “us”, “our”, “Snowcapped.com.au” refers to Snowcapped Tours Pty Ltd; a NSW, Australia registered company trading as Snowcapped Travel.
By using this website, you agree to be bound by these terms and conditions. Please read the terms and conditions carefully. If you do not accept the terms and conditions in full, please do not book with us. We reserve the right to change the terms and conditions without prior notice, and your continued access to and use of our services signifies your acceptance of the updated or modified terms and conditions.
The ski trips, packages and tours (the “Package” or “Packages”) outlined on the website are developed by Snowcapped.com.au. Rules for payment, changes and cancellation are specified herein. Once travel has begun, refund requests are reviewed on a case-by-case basis; refunds for unused portions of Packages, if any, may not be available.
Quotes, Bookings And Payment: Quotes for Packages are valid for 24 hours and subject to change and availability. A deposit is required at time of booking as per the terms and conditions. The deposit amount will vary. To book please verify and pay the deposit to avoid cancellation. The balance of the booking is generally due 70 days prior to travel. Early bird specials and other amounts may need to be paid in full earlier than the final balance due date. If you are booking less than 70 days out, full payment is required. Specific payment details may be obtained from your travel agent. If your quote doesn’t include accommodation, some of our special lift and transfer prices will not be available to purchase individually and we will contact you to discuss options. All prices and services specified herein are subject to change without notice. Upon booking and paying your initial deposit, you are in agreement you have read all the terms and conditions and understand that Snowcapped Tours PTY LTD will dispense all payments to relevant suppliers and airlines and you are authorising Snowcapped Tours PTY LTD to do so. In consideration of this, you will not hold Snowcapped Tours PTY LTD responsible for the insolvency and/or failure to perform of airlines, accommodations or any other principal involved in your booking and you will not ask your credit card provider to revoke any payments to Snowcapped Tours PTY LTD, where we are acting as the merchant on behalf of the suppliers. Any claims via credit card companies that are not feasible with the terms and conditions outlined and agreed upon will result in legal action for re-compensation.
Supplier Rules: Suppliers consist of all companies that Snowcapped.com.au offer services from as part of a booking from this site. Suppliers have their own terms and conditions that will also apply to you when booking through us. The passenger contract used by any Supplier shall be binding upon you. Some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier’s rules and restrictions may result in cancellation of your booking(s), in your being denied access to the applicable travel product or services, in you forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result.
Prepaid Reservations: Snowcapped.com.au pre-negotiates with vendors of accommodations, resorts, and others on your behalf. The rates displayed may be a combination of the negotiated room rates plus additional products or services as indicated plus the facilitation or service fee retained by Snowcapped.com.au. You authorise Snowcapped.com.au to charge your credit card for the total price quoted. Upon submitting your booking request, you authorize Snowcapped.com.au to facilitate hotel reservations on your behalf, including making payment arrangements with hotel suppliers.
Change Fees: All changes are subject to availability. Please let your travel agent or Snowcapped.com.au know of any desired changes as soon as possible. Any changes made will be assessed a processing fee of up to $200.00 per person. The processing fee is in addition to any applicable fees charged by third-party vendors.
Change Fees Whilst Travelling: All changes are subject to availability. You may be able to make the necessary changes directly with the vendor when traveling. If you require Snowcapped.com.au’s assistance with any changes while travelling, any changes made will be assessed a processing fee of up to $400.00 per person. The processing fee is in addition to any applicable fees charged by third-party vendors.
Cancellation Fees & Refunds: In the event of cancellation and deposit paid to secure land components will be non-refundable. Airlines each have various cancellation/refund policies, so these will need to be verified on a case by case basis. Generally, accommodation lodging properties do not provide refunds for late arrivals or early departures. Once bookings are paid in full, cancellations received outside 60 days prior to travel will be assessed a $500 per person fee plus any fees by the accommodation lodging property and or other vendors. If notice of cancellation is received 60 days or less before travel, regardless of the reason for the cancellation, all amounts paid will be non-refundable, unless otherwise stated by Snowcapped Travel. Consult with Snowcapped representative for specific details regarding cancellation fees and refund request procedures at time of booking. Any refunds due cannot be processed until the relevant funds have been returned by suppliers to Snowcapped.com.au. Insurance covering cancellation is strongly advised as some cancellation penalties are strict. Refunds will not be given for unused accommodation, car rental, transfers and ski passes, and these should all be processed through your travel insurance company.
When discussing cancellation options with front line staff who work for the suppliers, they may state that portions of your trip will be refundable, however they may not privy to our contractual arrangements with our suppliers and can give you incorrect information. Please check with Snowcapped.com.au first for correct cancellation information.
Late Payments: Please note that required payment dates are stipulated for strict payments to suppliers. Any late payments will incur the following charges. 1-7 days may incur a $100.00 per booking late payment charge. 8-14 days may incur a $250.00 late payment charge. Any late payments after 14 days of due date may incur a $500.00 per booking late fee plus any additional late charges stipulated by the suppliers. Please make sure your payments are finalised on the required dates to avoid any late fees.
Subject To Availability / Confirmation Request: When you see this on your quote or booking, this means it can take up to 24 hrs for us to confirm your accommodation / lodging for you. At time of booking, we will take a holding deposit on your credit card and endeavour to confirm your room(s) for you. If the room(s) are not available, we will discuss other room(s) options of similar standard – and if you are in agreement – we can confirm and book those rooms for you. If not, we will release the holding deposit on your credit card within 7 days or less.
Exchange Rates / Currency Adjustments: Please be aware that quotes / bookings are based on the valid exchange rate for that day only. If you wish to lock in the rate at time of booking, please pay your full amount at time of booking. Please note that the exchange rates will vary on a day to day basis and these will not be updated until your early bird payments, other payments or final payments is required to be made or if you wish to pay earlier than your due date. If you wish to pay in full prior to your scheduled final payment date, please contact to us prior to doing so. Once you have contacted us either prior or on your due date, we will adjust your booking accordingly, either up or down, based on the difference of the current exchange rate on that day and the original exchange rate the quote/booking was based on. Please not that currency adjustments on final balances are only based on outstanding amounts.
Lowest Package Price Guarantee: If you find a complete package price that comes in cheaper, we will beat this by 10% of the difference of the quote prices. This is based on the quotes being for the same products, same dates and same inclusions only and based on the complete package price from a registered Australian company in Australian Dollars and inclusive of all taxes and fees only. A package is based on two (2) or more land components and not individual components alone. A written quote must be presented to Snowcapped.com.au and this written quote must have been issued within a 24 hour period of Snowcapped.com.au’s initial quote being received. This is based only on products available to Snowcapped.com.au at the requested time of booking.
Lodging Star Ratings: Snowcapped.com.au uses star ratings as a guide only to compare properties. Star ratings are subject to change. If you have an accommodation lodging rating question you can email the Snowcapped.com.au reservations department.
Packages: Prices quoted include taxes where highlighted in writing on quotes and booking confirmations, and additional taxes, gratuities and service charges by the supplier may not be included. Every effort will be made by the accommodation lodging property to meet your requirements however we cannot guarantee rooms as room allocation is up to the discretion of the accommodation lodging property. Snowcapped.com.au reserves the right to substitute comparable alternative accommodation lodging, ground transfers and other Package elements if all other options are exhausted.
Frequent Flyer Points: Membership of airline loyalty schemes have many advantages. We recommend you contact the relevant airline for advice on their programs. If you are an existing member please ensure on check-in at the airport that your number has been registered and that the relevant airfare or partner airlines allows points to your scheme as we will not be responsible. Please retain all boarding cards until you receive your next statement from your airline loyalty scheme.
Airline Check In: Check-in desks open at least 3 hours before flight departure. Please allow at least 2 hours to check in for international flights and 1 hour for domestic flights.
Luggage: Please be aware airlines have strict and varied luggage policies and it is advised to call the airline prior to travel to check their policy. Snowcapped.com.au is not responsible for any costs incurred by airlines in relation to luggage.
Traveling With A Disability Or Special Needs: The Packages offered on Snowcapped.com.au may not necessarily meet the needs of persons traveling with disabilities. Snowcapped.com.au must be informed of any special needs at the time of the initial booking. Any additional special requirements or equipment needs and fees will be the responsibility of the customer.
Price Changes/Price Guarantee: Prior to full payment, Package prices are subject to change and availability without notice. Upon receipt of full payment and accommodation lodging confirmation; pricing is guaranteed. This guarantee does not extend to tax changes or fees beyond the control of Snowcapped.com.au made by governmental authorities. Any changes to bookings will be subject to the applicable Package’s price at the time of change plus any fees set forth herein.
International Destinations: Travel to certain destinations may involve risks. Snowcapped.com.au advises you to be aware of any travel warnings and advisories issued by your Government prior to travelling. By offering for sale travel to certain destinations, Snowcapped.com.au does not represent or warrant that travel to such points is advisable or without risk, and is not liable for damages or losses that may result from such travel.
Travel Insurance: Snowcapped.com.au recommends customers take out all necessary insurances prior to travel including and not limited to covering you and your family for medical expenses, while skiing, personal accident, loss of deposit and cancellation fees, baggage against damage, loss, theft and personal liability.
Passport, Visas & Required Documents: Please ensure that you are fully aware of all passport and visa requirements for your destination and that you allow adequate time to obtain them. You may be required to obtain additional documentation that are your sole responsibility. Many countries require that your passport be valid for at least 6 months beyond the actual departure from that country.
Liability: Adventure travel, high altitudes, skiing, snowboarding, heli skiing, cat skiing and ski resort activities involve risks about which the customer must make himself or herself aware.
To the extent permitted by law, neither Snowcapped.com.au nor any of its related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law). This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).
Governing Law: If any dispute arises between you and us, the laws of Australia will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Australia, and waive any right that you may have to object to an action being brought in those courts.
Acknowledgement: You acknowledge that you are 18 years of age or older and that you understand and agree with the above Booking Terms and Conditions and our Privacy Policy.
